The transfer of such waste from Union border areas to nearby treatment facilities in Switzerland, where high standards for the management of waste are maintained, would therefore no longer be authorised, bringing to an end a long-established practice. The ban on the export of that waste to Switzerland would consequently shift the transport of that waste to other countries and to waste management facilities located further away, and would result in the replacement of rail transport of waste with additional road transport. This would increase the management costs of that waste and generate a surplus of greenhouse gas emissions linked to its additional road transport, while giving rise to very limited benefits. Consequently, it is necessary to amend Article 44(2), point (f), of Regulation (EU) 2024/1157 to allow for the continuation of the export to Switzerland of mixed municipal waste destined for recovery.</P></CONS><CONS><P><NO.P>(2)</NO.P>Regulation (EU) 2024/1157 should therefore be amended accordingly.</P></CONS><CONS><P><NO.P>(3)</NO.P>Since the objective of this Regulation cannot be sufficiently achieved by the Member States, but can rather, by reason of the need for harmonisation, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union (TEU). In accordance with the principle of proportionality, as set out in that Article, this Regulation does not go beyond what is necessary in order to achieve that objective.</P></CONS><CONS><P><NO.P>(4)</NO.P>In view of the impending entry into force of the prohibition to ship mixed municipal waste for recovery, which would disrupt shipments of mixed municipal waste to Switzerland, and given that consents for such shipments given prior to the entry into force of that prohibition are valid for a maximum of one year, it is considered to be appropriate to invoke the exception to the eight-week period provided for in Article 4 of Protocol No 1 on the role of national Parliaments in the European Union, annexed to the TEU, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community,</P></CONS></GRCONS></PREAMBLE><DISPOSITIF><DINIT>HAVE ADOPTED THIS REGULATION:</DINIT><GR.ART><ARTICLE><TI.ART>Article 1</TI.ART><PARAG>In Article 44(2) of Regulation (EU) 2024/1157, point (f) is replaced by the following:<CITATION><P>‘(f)	the export of waste referred to in Article 4(3) shall be prohibited, except to Switzerland;’.</P></CITATION></PARAG></ARTICLE><ARTICLE><TI.ART>Article 2</TI.ART><PARAG>This Regulation shall enter into force on the twentieth day following that of its publication in the <STRING ITALIC="on">Official Journal of the European Union</STRING>.</PARAG><PARAG>This Regulation shall be binding in its entirety and directly applicable in all Member States.</PARAG></ARTICLE></GR.ART><SIGNATURE><P>Done at …,</P><P><STRING ITALIC="on">For the European Parliament	For the Council</STRING></P><P><STRING ITALIC="on">The President	The President</STRING></P></SIGNATURE></DISPOSITIF></TEXT></TCONSOLID></TXTLST></SDOCTA>
